This document is our "Privacy Policy" and contains details regarding your privacy concerns when using our services. This Privacy Policy applies to natural persons to which users of OWIS – legal entities are identified as controllers. OWIS is owned and operated by ORKA d.o.o. (ORKA Društvo za informacijske tehnologije, studije, istraživanje, inženjering, konsalting, trgovinu i usluge d.o.o., with registered seat at the address ul. Mula Mustafe Bašeskije br. 6, 71000 Sarajevo, Bosna i Hercegovina). Our aim is to inform you about our policies, procedures, and practices regarding the collection, use, and disclosure of any personal information you provide through OWIS.

This Privacy Policy is part of our Terms of Use. Terms defined in the Terms of Use carry the same meaning in this document. By using OWIS, you accept and agree to the Terms of Use and this Privacy Policy. By accessing and using OWIS, you confirm that you have read the Terms of Use and Privacy Policy and that you understand, agree to, and acknowledge all the terms contained within them.

This Privacy Policy applies also to visitors of the public website www.owis.com owned and operated by Orka d.o.o.

1.     Collection, Use, and Disclosure of Personal Information

To effectively manage OWIS and enable you to use it, we may process your personal information on behalf of OWIS user – legal entity identified as a controller of your personal data. We will not collect, use or store your personal information.

The personal information we process is generated during your use of OWIS and we are only using it inside the OWIS to improve and support the use of OWIS.

We may collect and process your personal data (name and surname, and e-mail address) if you subscribe to our newsletter available at our public website www.owis.com.

a)     Payment Information

We do not use or store your credit card information. However, if the payment is enabled through OWIS or public website www.owis.com, this information will be sent to an authorized electronic payment service provider which will directly receive and store such information to facilitate and manage your payment processes. We are not responsible for the use of your data by the electronic payment service provider. Please look at the privacy policy of the electronic payment service provider for more information.

 

b)     Use of Personal Information

Orka has access to personal data for which the OWIS user – legal entity is the controller, to the extent that the user grants access for the purpose of creating, establishing, updating, or maintaining OWIS for the user’s needs.

Orka does not take, store, or back up information and documentation from users that may contain personal data.

Orka is not a processor of personal data under the Law on Personal Data Protection in Bosnia and Herzegovina, unless the user authorizes Orka to process personal data under a processing agreement, in which case it will act solely according to the instructions and on behalf of the controller in accordance with the processing agreement. 

The OWIS user - legal entity is obliged to notify Orka if the General Data Protection Regulation (GDPR) applies to them, which is in effect in the EU, and is fully responsible for fulfilling obligations under the GDPR.

Orka reserves the right to use user data for statistical purposes to improve OWIS and related services. If the data used for statistical purposes contains personal data, it will be made anonymous.

 

c)     Disclosure to Third Parties

Your personal information may be disclosed to third parties for one or more of the following reasons:

  • Compliance with the law: in the case of any requests from courts, regulatory authorities, law enforcement agencies, and in similar situations necessary for compliance with applicable laws and regulations;

  • We may share your personal information with professional advisors, such as auditors, law firms, and accounting firms;

  • We may share your personal information with other third parties if the OWIS user – controller of your personal data direct us to do so or if you give us your consent. 

If you subscribe to our newsletter you agree that Orka may use the services of other suppliers, such as MailChimp, to send and analyze the performance of newsletters. Orka does not share your email address with these companies but uses them solely as platforms for sending newsletters. These platforms may record your email address in accordance with their terms of use, so you can inform yourself about the risks and potential consequences of recording your email address in their terms of use.

 

2.     Cookies

Like many websites, we use "cookies" at the public website www.owis.com to collect information. A "cookie" is a small file that is transferred to your computer's hard drive for record-keeping purposes.

3.     Storage and Retention Period

Your personal information, if collected, will be stored in Squarespace i Mailchimp database, which protects data using secure connections, authentication services, precise authorization, controls, and data encryption.  

We will retain your personal information until we have your consent or until we are legally obligated to do so. However, you may request access to your personal data or erasure, unless we have a legal obligation to continue processing such personal data.

 

4.     Security

Personal data, if collected, is stored using appropriate measures and procedures to prevent unauthorized access, maintain the security level of personal data, and use the data collected online appropriately. Industry standards and best practices are used to prevent any unauthorized access, use, and disclosure.

Although we take all reasonable steps to prevent unauthorized access to data, we cannot guarantee that some of the collected personal data will never be disclosed in a manner that contradicts the provisions of the Privacy Policy. To the fullest extent permitted by applicable laws and regulations, we are not responsible for any damage caused to you by third parties during accidental access to the data.

Online identity theft and account hacking, including practices currently known as "phishing," are very serious issues. Always be cautious when asked for your account information and ensure you are doing so within our secure system. We will never ask for your login details or credit card information in any unsecured or unauthorizeed communication (email, phone, or otherwise).

OWIS or Orka website may contain links to other websites, services, or offers owned, operated, or maintained by third parties. If you click on a third-party link, you will be redirected to that third-party website or service. We have no control over third-party websites and services and have no control over their privacy policies and terms of use.

By entering your email address and clicking the "Subscribe" button on the website www.owis.com, you give explicit consent to ORKA d.o.o. as the data controller to collect and process it in accordance with the provisions of the Law on Personal Data Protection in Bosnia and Herzegovina for the purpose of sending promotional content (newsletters) to the entered email address.

Promotional content (newsletters) will include notifications about events, promotional offers, actions, webinars, trainings, etc.

You can request the erasure of your personal data by clicking on the unsubscribe link in any promotional email sent.

We may update this Privacy Policy at our discretion.

The date of the last revision of this policy is located at the beginning of this page.

Regardless of changes in our Privacy Policy, we will never use the information you provide according to our current privacy obligations in a new way without prior notice. All changes will be in accordance with applicable laws and regulations.
